Motion to accept the Selectmen’s Minutes of June 27,2006 and July 5,2006, as written made by Selectman Steve Wood and seconded by Selectman Bill Henshaw.

All in Favor.

 

 

DEPARTMENT HEADS:

 

Thomas Fales, Police Chief-Commented that he was given the Parking & Traffic Ordinance by Denis Castonguay to review.

 

Tracy Fabrizio, Town Administrator & Treasurer:

  1. Treasurer’s report:  Tax Years 2003 thru 2005, Delinquent Taxes as of 07/07/06, Outstanding amount is at $50,774.54, taxes collected were $1,946.75. As of this morning

Outstanding taxes were under $50,000.00.

  1. Fiscal Year End Process:  Tracy came in on July 2nd and 3rd to finalize the year end

process.  Working Progress-finalize all expenditures and revenue for fiscal year end 6/30/06 and finalizing all opening balances for new fiscal year 2006-2007. A summary will be given to all Department Heads of all their accounts after tonight’s meeting.

  1. Municipal Building payment for fiscal year 2006-2007 processed and paid on 7/1/2006 in

the amount of $150,000.00.

 

Motion to accept the Treasurer’s Report was made by Selectman Bill Henshaw and seconded by Selectman Steve Wood.

All in Favor.

James Wood, Road Commissioner-Would like to receive the numbers for the new wages for Public Works.  Will meet with the Selectmen and Tracy after the meeting to get this.

 

Jerry Sabins, Transfer Station Manager-Informed the Board of selectmen that he would be taking a vacation from July 22nd to July 30th.  If any problems arise to call Bert Larochelle.

 

Denis Castonguay, Planning Board Chairman-will check on the legality on the Parking & Traffic Ordinance and will provide copies for review.

 

COMMENTS FROM THE FLOOR:

 

Bert Larochelle, Transfer Station-would like to know if there is a noise ordinance for Rte 9, mostly a problem with motorcycles.

 

Gino Camardese, Acting Chair-Lewiston is enforcing their Noise Ordinance.  We could check with Lewiston to see what they have and possibly copy it.

 

Denis Castonguay, Planning Board Chairman-Would like to know if there is progress on the roadside mower.  This was discussed in a previous meeting that Public Works new roadside mower was not being used because no one knew how to hook it up.

 

James Wood, Road Commissioner-The company that sold Public Works the mower is willing to swap the mower for one with a hydraulic arm for $800.00.  Was told that the Company would contact the Board of Selectmen.

 

Gino Camardese, Acting Chair-The Company should be called to discuss the deal.  This issue is to be continued on next week’s Agenda.

 

Unfinished Business:

 

  1. Pro-Link Plus Heavy-Duty Starter Kit: Continued from Selectmen’s Meeting

05/24/2006. Review possible commitment from Department Heads to assist with the cost of the kit.

    

Motion to permit the purchase of the Pro-Link Plus Heavy-Duty Starter Kit for $2279.95 made by Selectman Mark Duquette and seconded by Selectman Steve Wood.

All in Favor.

 

 

  1. Chief Tom Fales, requesting Board of Selectmen to amend the Parking & Traffic Ordinance- to include:  Any person wanting to close a road in Sabattus Must notify the Police and Fire Department in advance to road closure. (Issue tabled; from Selectmen’s Meeting 06/20/2006- Chief Fales to give copies of the ordinance to the Selectmen for their review.)
  2. Sanitary Sewer System located at the Municipal Building-Issues/Problems with system (Issue tabled; from Selectmen’s 06/20/2006)

Mark Duquette, Selectman-We had Glen Dube come over and fix the manhole in the front of the building that had all the concrete that dropped in.  Will look into the situation of the pipes being 3 inch instead of four.  The whole floor will not have to be dug up.  There is one section by the elevator floor that is accessible.

 

Gino Camardese, Acting Chair-We will keep this on next week’s Agenda.  Mr. Richard Behr, CEO has a copy of the plumbing plan and even has the memo stating that the 3-inch pipe is to be changed to a 4-inch.

 

  1. Community Room Usage Request/Mara Duncan-Girl Scout Troop 2186

1st and 3rd Monday 6:30-8:00p.m. (Continued from 06/27/06-Usage date 1st Monday is full, a different date is requested.  Discussion was made about availability of the room on Mondays.

 

Mara Duncan, Resident-asks Chief Don Therrien if it is possible to use the Fire Department for their meetings since the Community Room is unavailable on the 1st and 3rd Mondays.  The chief agrees to this as long as the driveway is not blocked in case of a call.

 

New Business:

 

  1. Mixers Inc. Liquor License/ Board to review and approve or deny.

 

Gino Camardese, Acting Chair-Mixers is changing ownership but not Corporation.  Must read the liquor license three times and ask for objections.  The ownership is going from Randy Greenwood to Michael Yohe.  Asked for any objections.

 

Mara Duncan, Resident-Asked how soon the transition was going to take place once the plans have been finalized.

 

Michael Yohe, Mixers soon to be new owner-The changing of hands could take from 2 to 3 weeks after signing.

 

Gino Camardese, Acting Chair-Asked if there were any objections in the change of ownership.

 

Mark Duquette, Selectman-asked Chief Fales if he had a chance to sit with Michael Yohe.  The Chief responded that he had and that he had no problems with the change of ownership.

 

Gino Camardese, Acting Chair-Asked for the third time if there were any objections.

 

Resident Dawn J. Zemla-Asked if any statements could be made.  Stated that she would like to see some things change and also stated that she thought Randy Greenwood did an excellent job but said that she felt the staff were not trained to handle violent situations.

 

Bill Henshaw, Selectman-Asked Randy if the staff were presently being trained under Scott Lansley.

 

Randy Greenwood, Mixers owner-All the staff members are certified under the Tip Certification.  It is standard procedure for the staff to escort any problem customer out and to gather their party and also ask them to leave.

 

Michael Yohe, soon to be new owner of Mixers-Realizes that there are some issues that need to be resolved.  He believes that his staff should be polite and courteous.  He is buying the bar to make it a better business and make it so that people will want to go there.  He feels that Friday nights are the problem night.  Would also like to sit with Chief Tom Fales to settle the issues.  He is also thinking of moving the door and building a L shape wall to cut down on the noise.

 

Motion to grant the liquor license to Mixers Inc. under Michael Yohe’s ownership made by Selectman Steve Wood and seconded by Selectman Mark Duquette.

All in Favor.

 

  1. Pat & Bob Boulette, Sabattus Residents- Complaints regarding Lake, water level too high and erosion on property.

 

Bob Boulette, Resident- lives on Long Beach Road, feels that the water levels have been too high the past few years.  Had a dock that washed out and is having a problem with soil erosion.

 

Steve Wood, Selectman-(also the Chairman for the Sabattus dam Commission) The gate was open all winter long.

 

Gino Camardese, Acting Chair-Care also has to be taken when opening the gates not to flood the Town of Lisbon.  Green and Wales also have a say on opening the gates.  Each Town has one Selectperson and two residents on the Board.

 

Pat Boulette, Resident- Passes out packets to each of the Selectmen,  It contains correspondence from the State of Maine DEP.  It was in response to Mr. Robert Boulette as to his inquiry regarding the effects of the drawdown of Sabattus Lake on the water quality.  Timing of the drawndown is critical to flush algae and associated phosphorus from the Lake.

 

Richard Behr, CEO- Mr. Boulette has a legitimate complaint but that complaint should go to the Dam Commission and should probably seek legal advice. The Town of Sabattus gave up 90% of the control of the Dam to the surrounding towns.  The Board of  Selectmen can no longer say yes to level the water like we did years ago.

 

Gino Camardese, Acting Chair-Would like time to read the pamphlets and would like the Board of Selectmen to attend the next Dam Commission Meeting which will be held on August 7 at 7 p.m.

 

  1. Charles MacDougall, Sabattus Resident-Letter/Requesting in writing grandfather rights and parental rights.
  2.  Ballot for MMA Executive Committee Officers & Directors-

-         Anne E. Swift-Kayatta, requesting support for candidacy, Vice-President

-         Ruth Marden, requesting support for candidacy, Vice President

 

Motion to continue the ballot for MMA on next week’s Agenda made by Selectman Mark Duquette and seconded by Selectman Bill Henshaw.

All in Favor.

 

Motion to continue the executive session with the Police Department to next week made by Selectman Steve Wood and seconded by Selectman Mark Duquette.

All in Favor.
